RECENT VERDICTS, SETTLEMENTS, AND APPEALSCATHY JOHNSON as Surviving Spouse of FREDDIE JAMES JOHNSON, SR., Deceased, and CATHY JOHNSON, as Administratrix of the Estate of FREDDIE JAMES JOHNSON, SR. v. HOOVER TRANSPORTATION SERVICES, INC. et al. Plaintiff’s husband was killed when the car he was riding in struck a slow-moving tractor-trailer on Interstate 95 in Savannah, Georgia. Defendants settled the case for $503,500.00 after being defeated at Summary Judgment. CAROLINA RAMIREZ v. O’NEIL G. DECOTEAU D/B/A DECOTEAU HOMES, O’NEIL G. DECOTEAU, JR., an Individual, and JORGE OSORIO. Plaintiff leaned against the railing of the deck at a friend’s house, and the railing gave way, causing Plaintiff to fall almost 15 feet, and causing catastrophic injuries to her. Defendants settled for $250,000.00 policy limits at the close of discovery. BELINDA MURRAY v. FOOTHILLS TRUCKING CO., INC., et al. Plaintiff was a passenger in a car traveling North on Interstate 95 when the car she was riding in was struck from behind causing soft tissue injuries to Plaintiff. Foothills settled for $30,000.00 at the end of discovery. NEWSOME vs. BANK OF AMERICA CORPORATION, BANK OF AMERICA TECHNOLOGY AND OPERATIONS, INC., et al. Plaintiff’s wrist was broken when the teller at the bank closed the drive-thru teller drawer on Plaintiff’s arm. Defendants agreed to an $11,000.00 settlement when the judge instructed Defendants to turn over evidence of other similar incidents (OSI). ZIMMERMAN v. OUTBACK STEAKHOUSE, et al., Plaintiff, blind from diabetes, bought a filet steak, since that cut of meat is the most pure and best cut of meat, and would give him the least trouble with his medical condition. After taking several bites of the steak, he bit down on something hard, and snapped his tooth off at the gum-line. Subsequently, Defendants took the steak and the substance away from Plaintiff and would not return it to be used as evidence. Plaintiff was required to undergo extensive dental repair to replace the tooth that was broken, and incurred thousands of dollars of medical treatment as a result of this damage. Defendant agreed to a post verdict settlement, demanding confidentiality of the terms of the settlement agreement. BROOM v. GREAT OWL COMPANY; GREAT OWL COMPANY v. LAWRENCE BROOM, Plaintiff bought a car from Defendant’s company, and then refused to pay for it. While attempting to evade repossession, Plaintiff eventually destroyed the car, and sued Defendant for not giving Plaintiff title to the destroyed automobile. Defendant counterclaimed for damages. On behalf of the Defendant, we proved that the automobile had a value, prior to its destruction, of $8,000.00 and post destruction of maybe $500.00. We further proved that Plaintiff had destroyed the automobile, and subsequently won the bench trial. STRONG, et al. v. ANNETTE’S BAKERY: Plaintiffs bought and began eating a bag of pork skins. When they were half way through the bag, they started feeling sick. Plaintiffs then noticed that the pork skins had flies cooked into the pork skins, and several in the bottom of the bag. Plaintiffs went to the emergency room, where they were treated and discharged, however, they remained physically sick for almost two weeks, as a result of the contamination. Prior to filing, Defendant settled but demanded confidentiality in the settlement agreement. IN RE: THELMAN HODGMAN: We brought an emergency Petition on behalf of Ms. Hodgman’s daughter because she was being denied access to her mother. The probate court agreed and issued an Order to that affect. Ms. Hodgman’s power of attorney filed an appeal. The Court of Appeals agreed with us and affirmed the probate court’s Order.
